Terms and Conditions for Grape Escape
1. Agreement to Terms
By booking and participating in a tour with Grape Escape South West Tours WA (hereinafter referred to as "the Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.
2. Bookings and Payments

Booking Confirmation: All bookings are subject to availability and will be confirmed via email upon receipt of full payment or a deposit as specified.

Payment: Deposit isrequired at the time of booking with the balance due 14 days prior to the tour. Payment methods accepted will be outlined on our website or during the booking process.

Pricing: All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices are subject to change without notice, but confirmed bookings will honor the price at the time of booking.
3. Cancellation and Refunds

Cancellation by Customer:

Cancellations made [e.g., 7 days or more] prior to the tour date will receive a full refund, minus any non-refundable booking fees or credit card charges.

Cancellations made between [e.g., 3 and 6 days] prior to the tour date will receive a [e.g., 50%] refund.

Cancellations made within [e.g., 48 hours] of the tour date, or no-shows, will forfeit the entire tour cost.

We recommend obtaining travel insurance to cover unforeseen circumstances.

Cancellation by Company:

The Company reserves the right to cancel or alter any tour due to unforeseen circumstances, including but not limited to, extreme weather conditions, road closures, winery availability, or operational issues.

In the event of a cancellation by the Company, we will offer an alternative tour date or a full refund.

The Company is not responsible for any additional costs incurred by the customer as a result of a cancellation by the Company (e.g., accommodation, travel expenses).

4. Tour Participation and Conduct

Age Restrictions: Participants must be 18 years or older to legally consume alcohol in Australia. Proof of age may be required. Underage participants are welcome on some tours but will not be served alcohol. Please check specific tour details for age restrictions.

Responsible Consumption: We promote responsible consumption of alcohol. The Company reserves the right to refuse service to, or remove from the tour, any participant who appears to be intoxicated, disruptive, or behaving in a manner that compromises the safety or enjoyment of others, without refund.

Punctuality: Tours will depart at the scheduled time. It is the responsibility of the customer to arrive at the designated pick-up location on time. The Company is not responsible for customers who miss the tour due to lateness and no refund will be provided.

Customer Conduct: Participants are expected to behave in a respectful manner towards our staff, other tour participants, and the staff and property of the wineries and venues visited. Any damage caused by a participant will be the responsibility of that participant.

Dietary Requirements/Allergies: It is the customer's responsibility to inform the Company of any dietary requirements or allergies at the time of booking. While we will endeavor to accommodate these, we cannot guarantee all requests can be met by third-party venues.
5. Health and Safety

Medical Conditions: Participants with any medical conditions, disabilities, or special needs that may affect their ability to participate in the tour should inform the Company at the time of booking.

Safety Briefing: Participants must adhere to all safety instructions provided by the tour guide.

Personal Property: The Company accepts no responsibility for loss or damage to personal property during the tour.

Insurance: We strongly recommend that all participants have their own travel insurance to cover personal injury, medical expenses, loss of property, and cancellation.
6. Photography and Marketing
The Company may take photographs or videos during tours for promotional and marketing purposes. By participating in a tour, you consent to the use of your image in such materials without compensation. If you do not wish to be photographed or filmed, please inform your tour guide at the beginning of the tour.
7. Limitation of Liability
To the maximum extent permitted by law, the Company, its employees, agents, and contractors shall not be liable for any injury, loss, damage, accident, delay, or inconvenience arising from or in connection with any tour, except where such liability cannot be excluded by law.
The Company acts as an agent for third-party suppliers (e.g., wineries, restaurants). While we strive to work with reputable partners, we are not responsible for their acts, omissions, or services.
8. Governing Law
These Terms and Conditions are governed by the laws of Western Australia, Australia. Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Western Australia.
9. Amendments to Terms and Conditions
The Company reserves the right to amend these Terms and Conditions at any time without prior notice. The updated Terms and Conditions will be posted on our website and will apply to all bookings made after the date of the amendment.
